It came down to credibility
Tuesday, October 14, 2008 at 03:08PM In the end, Senior Judge Jon Kerry Blackwood said it "strained credulity" to believe that attorney John Valliant and (now) ex-Commissioner Scott Moore were conversing by cell phone on real estate or anything other than plans to insure that the county commission deadlock on Jan. 31, 2007, could be broken in favor of the sheriff's faction. The "only logical conclusion," Blackwood said, was that Moore made false statements under oath when he said he could not recollect the details of his conversation with Valliant. Moore committed perjury, a misdemeanor, the judge concluded, misconduct performed "knowingly and willfully," thus subjecting him to ouster.
Judge Blackwood recessed court at 10:40 a.m. and returned with his decision at 11:15 a.m., a scant 35 minute interval. One wonders if it would take that long if Ragsdale's ouster case were presented to this no-nonsense judge.

We can only hope that we either get to Ragsdoll's ouster, or TBI charges resulting in resignation in 2009!
The wording in the judge's order is very telling of his thoughts about the commission if you ask me.
I wonder if there are any other scared commissioners now?
